We work with a small number of solicitors, providing guidance and expertise as required throughout the course of the claims process.

Trustee and Deputy Support

Gresham WM help trustees and deputies to ensure that they comply with their duties as defined by the Trustee Act 2000 and the Court of Protection.

 

Our services for trustees and deputies include the following:

 

  • The implementation and ongoing review of a structured investment portfolio designed to ensure that trustees and deputies comply with the Trustee Act 2000 and the requirements set out by the Court of Protection.
  • The provision of financial planning services tailored to the claimant’s needs and circumstances, accounting for their entitlement to welfare benefits.
  • Tax management.
  • Guidance in respect of the purchase of residential property (by trust or otherwise). Our experience in this area extends to the purchase of council housing under right-to-buy and retention of the available discount.
  • The completion of annual cashflow analyses to assess sustainability of income delivered by lump sum awards.
  • Guidance in respect of carer cover and family care payments.

Investment Management

Implementing an appropriate investment strategy is vital in ensuring that claimants receive the full benefit of an award throughout their lifetime.

Gresham Wealth Management construct investment portfolios with the objective of achieving long term capital growth, managing risk and providing liquidity. At the heart of the investment strategy will be the claimant’s projected care needs, expenditure requirements, ongoing income sources (PPO, welfare benefits, earnings and pension income), asset position and risk profile.

Ensuring that the appropriate level of risk is taken on an ongoing basis is paramount when managing personal injury awards. Balancing the need for access (in the form of regular and lump sum withdrawals) and capital growth requires a strong appreciation of the risk-return characteristics of the asset types that make up the claimant’s investment portfolio.

Our Investment Committee is responsible for the construction and maintenance of investment portfolios. The members of the Committee are highly qualified and offer a significant number of years’ experience in this field. The in-house investment process ensures that we have complete oversight of clients’ exposure to individual asset classes, geographic regions and industrial sectors.

The Investment Committee consider guidance provided by the Court of Protection and case law in providing investment services in respect of personal injury and clinical negligence awards.

Personal Injury Trusts (PITs)

Where claimants are in receipt of welfare benefits or are expected to require access to local authority care services in the future, it is important that they seek advice about the use of Personal Injury Trusts (PIT’s).  Our service ensures that claimants understand the purpose of the PIT and the award is managed in such a way as to maximise entitlement to welfare benefits on an ongoing basis. We will arrange for the trust deed to be drafted and open the trust bank account, where appropriate.

Pre-Settlement Services

Gresham Wealth Management work with claimant solicitors pre-settlement with a view to ensuring that the right outcome is achieved for the claimant.

In this respect, our services include the following:

  • The provision of suitability reports in respect of Periodical Payments vs. Conventional Lump Sum settlements consistent with current legislation.
  • The completion of cashflow analyses with a view to determining the level of income that could be sustainably delivered from lump sum awards.
  • Arranging for the creation of personal injury trusts and trust bank accounts to ring-fence interim payments and in preparation of final settlement.

Post-Settlement Services

Having worked hard to ensure clients have the funds available to live their life to the highest possible standard, ensuring receipt of the ongoing advice needed is the next logical step.
